Compliance with Tanzanian Public Procurement Act increases, but misses target

Compliance with the Public Procurement Act in Tanzania increased slightly last year, but was still below the target set out by the regulator according to its annual audit.

On the basis of seven performance criteria, the audits found an average level of compliance of 65 per cent, slightly above the last year’s compliance level of 64.3 per cent. But this was below the target of 72 per cent, which was set for 2013/14. Only 19 out of 68 procuring entities (PEs) had satisfactory compliance levels above the 72 per cent target.

Seven were assessed to have good performance, that is, above or equal to 80 per cent, 12 PEs performed fairly between 72 per cent and 80 per cent, and 42 PEs were assessed to have unsatisfactory performance below the targeted level of compliance of 72 per cent. A report from the Public Procurement Regulatory Authority concluded although overall compliance was below the target, the performance of the audited PEs was fair in general.

The audits were to determine whether the procedures, processes and documentation for procurement and contracting were in accordance with the provisions of the Public Procurement Act, procurement regulations and the standard documents issued by Public Procurement Regulatory Authority.

The audits covered 4,532 contracts involving 68 procuring entities (PE). They also looked at whether contracts were being implemented in accordance with stipulated contract terms and conditions, and whether value for money was achieved in spending public funds on selected construction contracts.
