Job Description

Wood Digital Consulting (DC) is currently recruiting for a Commercial Manager to support one of our UK projects within the System Integration business.

This is a hybrid role that can be based anywhere in the UK, mobility and travel to customer sites and face to face meetings with colleagues will be expected as required.

Must be able to pass HMG Baseline Personnel Security Standard (BPSS) check.

The Commercial Manager's primary role will be to ensure effective commercial co-ordination of relevant project in accordance with all relevant Company commercial policies and procedures. This includes delivery of programs commercial reporting to Business Unit and ensure all commercial procedures are followed and reviewed. Implementation and delivery of key policies and procedures including the Financial Management Framework and Tender Governance Procedures. Adherence to all requirements of the client contract T&C's with specific emphasis on reporting and change management in line with the NEC4 client contract.

Responsibilities

Leads and directs the management of:
  • Pre-award activities including support to the proposals team in terms of performing a commercial review of tender documents, reviewing commercial proposals prior to submission for internal approval, preparing pricing and commercial qualifications
  • All activities within the Tender governance processes across the sub-BG
  • Compliance with Woods commercial policies, processes, and procedures within sub-BG (tender governance, financial instruments, contracting policy, etc.)
  • Risk management process including risk identification, mitigation planning, and administration of risk process in conjunction with operations
  • Contractual negotiation strategies for client contracts, JV's, and teaming agreements in conjunction with the bid team and key stakeholders
  • Negotiation of Terms and Conditions with clients and suppliers
  • Main contract administration of across sub-BG including timely provision of commercial deliverables (e.g. bonds, PCGs, evidence of insurance), correspondence management, and management of change to optimize commercial entitlements
  • Development, implementation, and maintenance of project commercial handover / plans including commercial strategy, subcontracting commercial strategy, and profit improvement plans
  • Regular project cost analysis/reviews to maximize recoverable costs, minimize disallowable costs, and ensures adequate cost accruals and provisions are in place
  • DOA is maintained, communicated, and complied with across the sub-BG
  • Project cashflow forecasts, expenditure, invoice preparation, and expediting of payments, with limited support and supervision, and in accordance with client contract requirements and Wood processes and procedures
  • Ensuring the accuracy of invoices and supporting information/data and maintaining project invoice registers
  • Developing subcontracting commercial strategy in conjunction with Project Management, supply chain, and other functions, as required
  • The compilation of subcontract documents, including main contract flow downs, pricing, and payment prior to execution, subcontract filing / retention of records
  • Regular cost analysis to:-
    • maximize recoverable costs
    • minimize disallowable costs
    • identify areas for cost saving and
    • ensure adequate cost accruals and provisions are in place
  • The preparation, delivery, and analysis of inputs to key contract and internal project reporting requirements and ensure the accuracy of project forecasts
  • Commercial representation in monthly BU / BG / Sub BG project reviews
  • The preparation and delivery of main contract and subcontract (if applicable) close-out requirements in full accordance with contract requirements while optimizing Woods commercial recovery
  • Governance and implementation of Financial Management Framework within assigned project / sub-BG
  • Align project / sub-BG specific commercial requirements with WOOD commercial processes and procedures and communicate to relevant personnel
  • Resource competent commercial personnel
  • Manages and supervises personnel development and training of the designated commercial team
  • Coordination of contract reviews and the development of qualifications / redlines in conjunction with the Contracts function to ensure the balance of risk is appropriate for the associated services and remuneration model
Qualifications

Qualifications:
  • Degree in Quantity Surveying, Law, or Business Studies, along with appropriate professional qualification (preferred)

Knowledge, skills and experience:
  • Significant experience (8-12 years) in a similar role with good level (4+ years) of leadership / management experience
  • Experience of NEC contracts, particularly NEC4, desirable.
  • Proven experience in contract administration including change management
  • Awareness of all relevant corporate and project procedures
  • Experience in contract negotiations
  • Experience in claims and dispute resolution (pre and post-litigation experience preferred)
